In this issue, we describe recent developments with respect to permitting employees to have a second, or “side job” under Japanese labor and employment practice. The Ministry of Health, Labour and Welfare has recently announced the Guidelines for the Promotion of Side Jobs and has been promoting the expansion of permitting employees to have additional work opportunities. There are a wide range of issues that should be taken into consideration when having employees with a side job, and foremost how the company properly manages the working hours and pays the overtime increased wages for its employees engaging in side jobs.
We also mention recent law amendments that impact employers.
