Simmons & SimmonsとTMIは、2005年4月に外国法共同事業を設立し、その後、太陽光、風力、バイオマス発電プロジェクトを含む再生可能エネルギー分野で、海外の再生可能エネルギー事業者や投資家のために協働してきました。 TMIは、Simmons & Simmonsとの間の長年の関係に基づき、Simmons & SimmonsのClean Energy Tool（CET）の日本セクションに寄稿いたしました。日本において再生可能エネルギーの重要性が高まっているため、TMIはSimmons & SimmonsのCETに寄稿したものです。日本政府は、2020年10月に菅総理(当時)により宣言された2050年までの脱炭素達成を目指しています。 この目標を達成するためには、再生可能エネルギープロジェクトの導入が重要な役割を果たすことになります。

Simmons & Simmons によるCETは、日本を含む40以上の国における再生可能エネルギープロジェクトの開発及び運営のための法規制概要へのオンラインアクセスを提供しています。 Q&Aスタイルの情報は、すべての国及び地域で標準化されており、利用者が再生可能エネルギープロジェクトを複数の国及び地域に渡って市場に導入する方法を容易に比較できるようになっております。 CETは、クリーンエネルギーインフラを検討している開発業者や投資家にとって、最も重要な疑問に答えるために、信頼性のある、一貫した、容易にアクセス可能な情報を提供しています。

現在、日本に関する内容には、(i)ストラクチャリング及びファイナンス、(ii)収益、(iii)系統連系、(iv)土地、(v)水素及び(vi)紛争に関するセクションが含まれております。 CETは定期的に更新されており、2022年4月の再生可能エネルギーに関する法規制の改正に関する詳細についても含まれております。

TMIのエネルギープラクティスグループ代表パートナーの越元瑞樹弁護士は、「2050年の脱炭素達成のためには、再生可能エネルギーの分野が非常に重要です。一方、日本では、FITからFIPへの移行など、再生可能エネルギーイニシアティブに関連した多くの問題があります。 日本では、エネルギー供給強靭化法が2022年4月1日に完全施行されるなど、現在、多くの改正が行われております。また、 コーポレートPPAが、日本企業の間において活発化しています。 このような動きを踏まえ、再生可能エネルギー分野の関係者が、この分野における新たな法規制の動向を理解し、常に把握することが、これまで以上に重要となっております。

TMI contributes to Japan sections to Simmons & Simmons’ online Clean Energy Tool.

Simmons & Simmons and TMI established a foreign law joint enterprise in April 2005 and, since then, have worked together in the renewable energy area, including solar, wind and biomass power projects for foreign renewable energy operators and investors. Based on this long-standing relationship, TMI has developed the sections on Japan for Simmons & Simmons’ Clean Energy Tool. TMI’s contribution to this formidable resource reflects the growing importance of renewable energy in Japan. The Japanese government currently aims to achieve carbon zero by 2050, which was declared by then Prime Minister Mr. Suga on October 2020. The introduction of the renewable energy projects is important role for achieving this goal.

The Simmons & Simmons Clean Energy Tool provides online access to legal and regulatory overviews for the development and operation of a renewable energy projects in over 40 jurisdictions, including Japan. The Q&A-style information is standardised across all jurisdictions, enabling subscribers to easily compare how to bring renewable energy projects to market across multiple jurisdictions. The tool provides trustworthy, consistent, and easily accessible information to answer the most important questions for potential developers and investors in clean energy infrastructure.

The Japanese content currently includes sections on (i) structuring and finance, (ii) revenue, (iii) grid, (iv) land, (v) hydrogen, and (vi) dispute areas. The tool is updated regularly and includes details regarding the amendment of renewable energy laws and regulations in April 2022.

TMI Energy Partner Mizuki Koshimoto says, “The field of renewable energy is very important for achieving the goal of zero carbon in 2050. On the other hand, there are many issues related to renewable energy initiatives in Japan, such as the transition from FIT to FIP system. Many revisions to renewable energy regulations are currently being made in Japan, including renewable energy related laws being effective on April 1, 2022.
