On April 1, 2024, important amendments to Japan's discretionary labor system came into effect, requiring new procedures for the introduction and continuation of the system. Although the type of work to which this system applies is strictly limited by law, it offers a flexible working arrangement where workers have discretion in managing their work hours and are considered to have worked the deemed working hours determined by a labor-management agreement or a resolution of a labor-management committee.
In this newsletter, we will explain the basics of the discretionary labor system and the main content of the recent amendments.
